Among people who were currently using e‑cigarettes, the proportion of people who used them daily remained stable from 2016 (42%) to 2019 (42%), then increased in 2022–2023 (49%). District Court for the District of Columbia ruled that e-cigarettes did not meet the criteria for drug-delivery devices and therefore were exempt from regulation under the FFDCA.
